Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Breath Launcher ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and the developer of Breath Launcher. We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.

2. License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on an Android device you own or control, solely for your personal, non-commercial purposes.

This license does not include the right to:

• Copy, modify, distribute, or sell the App or any portion of it
• Reverse engineer, decompile, or disassemble the App, except to the extent permitted by applicable law
• Remove, alter, or obscure any proprietary notices or labels on the App
• Use the App for any commercial purpose or for any public display
• Use the App in any way that violates applicable local, national, or international law

3. Accessibility Service Usage

Breath Launcher uses Android's AccessibilityService API to detect which app is in the foreground and, where configured by you, to display a breathing exercise before granting access to selected apps. By enabling the accessibility service for Breath Launcher, you understand and agree that:

• This permission is used only for the foreground app detection feature described above
• The App does not use this permission to read screen content, record input, capture screenshots, or collect any other data
• You may revoke this permission at any time through your device's Accessibility settings, which will disable the app-blocking and breathing-pause features
• You grant this permission voluntarily and understand its scope as described in our Privacy Policy

Misuse of accessibility permissions is a violation of Google Play policy and these Terms. You agree not to attempt to use the App's accessibility access for any purpose other than its stated function.

4. Notification Listener Service

Breath Launcher requests the Notification Listener permission to display a music widget showing the currently playing track. By enabling this permission, you understand that:

• The App reads only media session metadata (track name, artist) visible in the notification shade
• Personal notifications, messages, and alerts are not read or stored
• You may revoke this permission at any time through Android settings, which will disable the music widget feature only

5. No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The App will produce any particular result with respect to your screen time, habits, or wellbeing
• Any errors or defects in the App will be corrected
• The App will be compatible with all Android devices or future Android versions

Breath Launcher is a tool to support mindful phone use. The responsibility for your habits, attention, and digital wellbeing rests entirely with you.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER OF BREATH LAUNCHER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the App
• Any conduct or content of any third party, including other apps on your device
• The accessibility service blocking or failing to block any application
• Any changes made to your device configuration or default launcher settings
• Loss of locally stored data due to device failure, factory reset, or app uninstallation

Our total liability to you for any claims arising from your use of the App shall not exceed zero dollars ($0), as the App is provided free of charge.

7. App Blocking and Parental Controls Disclaimer

Breath Launcher's app blocking features are designed as a personal mindfulness tool and are not a parental control solution. The blocking mechanisms depend on Android's AccessibilityService and can be bypassed by a determined user with device knowledge. We make no representation that the blocking features are foolproof or suitable for supervision of third parties.

Do not rely on Breath Launcher as the sole means of restricting access to content for minors. Use purpose-built parental control solutions for that purpose.

8. Third-Party Services

The optional weather widget in the App fetches data from a third-party public weather API. Your use of the weather feature is subject to that provider's terms of service. We are not responsible for the availability, accuracy, or content of weather data provided by third parties.

The App is distributed through Google Play. Your download and installation of the App are subject to Google Play's Terms of Service.

9. Updates and Changes to the App

We may update the App from time to time to add features, fix bugs, or improve performance. Updates distributed through Google Play may be applied automatically depending on your device settings. We are not obligated to maintain any particular feature or behavior across versions.

We reserve the right to discontinue the App at any time without notice. Because all your data is stored locally, any data you have entered will remain on your device even if the App is discontinued.

10. Termination

This license is effective until terminated. It will terminate automatically if you fail to comply with any provision of these Terms. Upon termination, you must cease all use of the App and uninstall it from your device. Sections 5 (No Warranty), 6 (Limitation of Liability), and 11 (Governing Law) survive termination.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in that jurisdiction.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.

13. Entire Agreement

These Terms, together with the Privacy Policy (available at breath-launcher.app/privacy), constitute the entire agreement between you and us regarding the App and supersede all prior agreements, representations, and warranties.
